Illinois digital asset transaction tax highlights state taxing power despite CLARITY Act

Illinois has introduced what it calls a Digital Asset Tax Act, imposing a 0.2 percent levy on cryptocurrency transactions, transfers and custody services involving state residents from Jan. 1, 2027. The move highlights that federal efforts to unify crypto rules do not necessarily limit state taxing authority. The measure covers exchanges, custodians and brokers serving Illinois residents, while excluding direct wallet-to-wallet transfers between individuals.
