XRP is already classified as a digital commodity under the interpretation of U.S. federal regulators. But the "Clarity bill," scheduled for a vote in September, is significant because it could cement that status in law and create a supervisory framework for spot markets.

On Aug. 20, blockchain media outlet The Crypto Basic pointed to a key issue as not whether XRP becomes a commodity, but how long that classification lasts and whether a system is put in place that can bring in institutional investors.

The backdrop is that on March 17 the U.S. Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) issued joint interpretive guidance. It listed XRP, along with bitcoin, ether and solana, as an example of a digital commodity. This is significant because XRP was recognized at the federal level as having the characteristics of a commodity.

But the classification is ultimately a legal interpretation by regulators. SEC Chair Paul Atkins (폴 앳킨스) stressed the need for legislation as he announced a draft of new rules related to crypto fundraising on Aug. 18. He said a law made by Congress is essential if the current work is not to be reversed later by other regulators. That amounts to the authorities themselves acknowledging that the March interpretation is not permanent.

For that reason, the significance of the "Clarity bill" does not stop at a simple confirmation of classification. If the bill passes, XRP's status would become a matter of law written by Congress. At the same time, the CFTC would be given effective supervisory authority over digital commodity spot markets.

A gap remains between market expectations and actual money flows. XRP secured a favorable court ruling and then a federal-level commodity classification, and 7 spot exchange-traded funds (ETFs) have been launched in the United States. But total inflows into related products since launch amount to $1.51 billion, with $666 million concentrated in the first month. Net inflows for the first half of 2026 totaled about $329 million, and fell to $27.29 million in July. Net inflows for the week ended Aug. 8 were only $1.01 million.

Net inflows extended for 4 consecutive weeks, but large follow-on money has yet to be confirmed. That means legal clarity alone is not enough to draw institutional demand. For institutional investors, it is important not only how XRP is classified, but also whether there are systems and infrastructure to hold and trade it safely in line with internal rules.

The Senate timetable is not straightforward. The Senate returns on Sept. 14, and a vote on Sept. 15 is expected to be a procedural vote to open debate, not passage of the bill on the floor. After that, hurdles remain including the 60-vote threshold, coordination between a Senate Agriculture Committee version and the House version, and final signing procedures. Not many view all procedures as likely to be completed within this year.

In the end, the key issue in the September vote is not whether XRP suddenly becomes a commodity. The bigger questions are whether Congress will lock in the commodity status XRP has already secured in law, and whether it will establish an oversight framework that can bring institutional money into U.S. digital asset spot markets. Passage of the procedural vote, delays and an unexpected setback could all increase volatility for assets like XRP that sit in a technically sensitive zone.
