Payward, the parent company of Kraken, is offering U.S. customers perpetual futures trading using Hyperliquid infrastructure.

Payward is expected to become the first HIP-3 market operator regulated by the U.S. Commodity Futures Trading Commission (CFTC).

If regulators approve, Bitnomial, a CFTC-regulated entity under Payward, will create and run the market. Bitnomial will also handle contract clearing and settlement. Customer accounts will be managed by NinjaTrader Clearing, registered as a futures commission merchant.

Hyperliquid will soon carry out a network upgrade. After the upgrade, a market operator will be able to open a market that allows trading only by approved users. The list of eligible users will be recorded and managed on the blockchain.

This feature is optional and does not affect existing HIP-3 markets. The feature is currently running on a testnet, and detailed specifications may change.
