The U.S. Commodity Futures Trading Commission (CFTC) has sued New Mexico over sports betting offered by prediction market Kalshi, The Block reported on Thursday.
The CFTC filed the lawsuit on Thursday in federal district court in New Mexico against Governor Michelle Lujan Grisham (미셸 루한 그리샴) and Attorney General Raul Torres (라울 토레스), the report said. It aims to block the New Mexico state government from trying to apply gaming laws. As a dispute continues over whether prediction markets, particularly sports betting, fall under state or federal jurisdiction, the filing is the latest move by the CFTC to assert its authority, The Block said.
New Mexico last week indicted Kalshi, citing that it did not obtain a licence and allowed participation by users under the legal age of 21. Torres said, "Legal gaming in New Mexico is operated only under tribal-state gaming compacts or strict state regulation."
Over the past several months, the CFTC has filed lawsuits asserting jurisdiction against multiple states, including Wisconsin, Illinois, Arizona, Connecticut and New York.
