[Digital Today reporter Chi-gyu Hwang] Elon Musk lost a lawsuit he filed against OpenAI CEO Sam Altman, CNBC reported on May 18. The jury threw out Musk's claims after less than two hours of deliberations.

The court, led by U.S. District Judge Yvonne Gonzalez Rogers, agreed with the jury's finding that Altman and OpenAI were not liable, the report said.

The court said claims for breach of a charitable trust and unjust enrichment were dismissed as time-barred. Rogers, closing a three-week trial in Oakland, California, said there was substantial evidence supporting the jury's decision. Musk's lead lawyer, Stephen Mollo, reserved the right to appeal.

Musk filed the lawsuit against Altman and OpenAI in 2024. He said they broke a promise to keep the AI research lab nonprofit. Musk helped found OpenAI in 2015 but left the board three years later.

Microsoft, which invested in OpenAI in 2019, was also named as a defendant. Musk said Microsoft aided OpenAI in violating its charitable trust. The court also dismissed claims against Microsoft.

OpenAI and Microsoft lawyers hugged and patted each other on the back in celebration as they left the Oakland courthouse, CNBC reported.

Musk sought up to 134 billion dollars in "unjust enrichment" from OpenAI and Microsoft through the lawsuit. He has demanded that Altman and OpenAI President Greg Brockman step down from management and that a 2025 restructuring that enabled growth of the for-profit arm be reversed.
